After nearly four years of litigation, the federal government dropped its civil forfeiture case against Oakland-based Harborside Health Center, bringing an end to a legal battle that had threatened to shut down one of the nation's largest medical cannabis dispensaries. The case, initiated in 2012, became a significant example of the conflict between federal cannabis prohibition and California's medical marijuana laws.
Our very own Henry Wykowski, who served as Harborside's lead attorney, was featured in both CBS San Francisco and New Cannabis Ventures discussing the resolution of the case. Henry emphasized that Harborside had remained committed to defending its right to operate throughout the litigation and welcomed the government's decision to withdraw its forfeiture action. The resolution also reflected an agreement by Harborside to discontinue its related legal action against the Department of Justice.
The outcome represented a significant legal victory for Harborside and its patients, allowing the dispensary to continue operating without the threat posed by that federal forfeiture action. The case highlighted the importance of legal advocacy in navigating conflicts between state and federal cannabis laws and marked an important moment in the development of California's medical cannabis industry.
